EPBC Act exemptions and exemptions register

The Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) allows the minister to declare exemptions from some requirements in certain situations.

The minister is required to publish all notices of exemption, and the reasons for granting the exemptions.

Environmental impact assessments

The minister can exempt some actions from requirements such as:

  • completing an environmental assessment
  • seeking approval for that action.

The minister can only make this decision if it's in the national interest. They might consider reasons such as, but not limited to, defence, security or a national emergency declaration. If you think you might be eligible for this kind of exemption, contact us before you submit your referral application.

The minister has 20 business days from receiving your application to decide whether or not to grant an exemption.

If the exemption is granted, we'll notify you within 10 business days of the minister's decision. We'll also publish a notice of the decision on our website.

Listed species and ecological communities permits

You need a permit for any action in or on a Commonwealth area if that action may kill, injure, take, trade, keep or move listed:

  • cetaceans (aquatic mammals)
  • threatened species or ecological communities
  • migratory species
  • marine species.

The minister can exempt a person from the requirement to seek permits for the action. They can only make this decision if it's in the national interest.

National emergencies

The minister may exempt actions necessary to prevent, mitigate or deal with a national emergency. However, the Minister may consider other reasons for an exemption.

Commonwealth agencies

The minister may exempt actions, or a class of actions, that a Commonwealth agency will take from assessment and approval processes. However, they must be satisfied that the agency will comply with state and territory environment protection laws.
